Cycling Visionaries Awards – Voting Rules


These are the official terms and conditions (the “Official Voting Rules”) for voting for the “Cycling Visionaries Awards online voting” (the “Awards”) on (the “Website”) between 1 and 15 April 2013. These Official Voting Rules are incorporated by reference into the Website’s Terms of Use Agreement. The Website and the Awards are owned and operated by stadt wien marketing gmbh on behalf of the City of Vienna (“VC13”).

These terms and conditions and any matters relating hereto are governed by the laws of the Republic of Austria, and the federal courts in Vienna, Austria, shall have jurisdiction regarding any and all relevant disputes.


To support your favourite project, you can vote on the individual project submission pages. On the respective project submission page, you can click on the button “vote now!” and will then be asked to enter your e-mail address in a dialogue box. Hit “Send your vote”. An e-mail containing a link to confirm your vote will then be sent to your mail address. Your vote will only be counted if this link was activated.

You will be allowed to vote only once per project and e-mail address. You are free to support as many projects as you want (always with one vote only).

The details requested during the voting process will be solely used for administration of the Awards. The data used for administration of the Awards are subject to Velo-city 2013 privacy policy and the Data Protection Act 2000 (Federal Law Gazette I 195/1999 as amended by Federal Law Gazette I 51/2012).


Voting will commence on 1 April 2013, at 12:00 CET and shall continue throughout 15 April, at 12:00 CET. The Voting Period is subject to change at VC13’s sole discretion. The winners in each category will be announced within a week of completion of the voting procedure.

3. PRIZES (“Cycling Visionaries”)

Winners of the Cycling Visionaries Awards are entitled to free participation in the foremost global venue on urban cycling, the Velo-city conference, held in Vienna, Austria, in June 2013.

Free participation in the conference equals a full conference ticket valid for the Velo-city 2013 conference in Vienna, Austria. The prizes exclude any reimbursement of travel costs or financial aids of any other sort.

There are 30 prizes available, which will be allocated among the Award contestants (submitters to the “Cycling Visionaries Awards”) and distributed among the Award categories as follows:

  • Advocacy and Social Projects: 10 conference tickets equalling ten prizes awarded to ten “Cycling Visionaries”
  • Science, Research and Development: five conference tickets equalling five prizes awarded to five “Cycling Visionaries”
  • Design, Fashion and Cycling Equipment: five conference tickets equalling five prizes awarded to five “Cycling Visionaries”
  • Urban Planning and Urban Design: five conference tickets equalling five prizes awarded to five “Cycling Visionaries”
  • Cycling and the Arts: five conference tickets equalling five prizes awarded to five “Cycling Visionaries”
  • If a prize winner fails to respond within ten (10) days to the e-mail notification of his/her winning, such winning entrant shall be deemed to have forfeited his/her claim to such prize, and stadt wien marketing gmbh as the organiser of Velo-city 2013 shall not have any obligation whatsoever to compensate the winning entrant in any way.


Votes will not be accepted prior to or after the Voting Periods, and only votes for nominees in categories contained on the Website will be accepted. The use of any device to automate a vote is prohibited, including but not limited to software-generated, robotic, programmed, script, macro or other automated votes.

VC13 reserves the right at its sole discretion to determine the Cycling Visionaries and to disqualify any individual (and remove any votes from that individual) it suspects or finds: (a) to have used a software-generated, robotic, programmed, script, macro or other automated vote; (b) to have tampered with the voting process; (c) to be acting in violation of these Official Voting Rules; or (d) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. VC13 reserves the right to remove votes at its sole discretion.

If, for any reason, any aspect of the voting process cannot run as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical or system failures or disruption, force majeure or terrorist attacks, or any other causes beyond the control of VC13 which corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting process, or for any reason VC13 deems necessary, VMN reserves the right at its sole discretion to cancel, terminate, modify or suspend the voting process and reserves the right to determine the Cycling Visionaries at its sole discretion.

You participate in this voting process at your own risk. VC13 and any of their respective parent companies, affiliated companies, related companies, sponsors, subsidiaries and advertising agencies, and any entity associated with this voting process (“Released Parties”) are not responsible nor shall not be liable for: (i) difficulty accessing telecom systems; (ii) errors in transmission; (iii) service outage or delays or any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail or players on account of any technical problems or traffic congestion on the Internet or the Website or any combination thereof; (iv) any incomplete, lost, late, delayed, misdirected or garbled votes or failure to receive votes; (v) injury or damage to you or to any other person’s computer or mobile device related to or resulting from participating in, or downloading materials or software, or attempts to participate in or download materials or software related to this voting process or (vi) failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems, cellular equipment towers, telephone systems or wireless services or other communications malfunctions. The Released Parties are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of the Released Parties that may cause the voting to be disrupted or corrupted; (ii) typographical or other errors in the printing, offering or administration of the Official Voting Rules or (iii) any errors in the announcement of potential winner(s).

The participant assumes all liability for any injury or damages caused or claimed to be caused by his/her participation in the voting opportunity described in these Official Voting Rules, and herewith releases the Released Parties and any party associated with the production or exhibition of the Awards and their respective officers, directors, employees, shareholders, parents, subsidiaries and affiliates from any such claim or liability.

By participating in this voting process, you agree to be bound by these Official Voting Rules. Failure to comply with the Official Voting Rules may result in a voter’s disqualification at the sole discretion of VC13. VC13 reserves the right to modify these Official Voting Rules at any time at VC13’s sole discretion.

All interpretations of these Official Voting Rules and the decisions of VC13 relating to this voting process are final.

The submitters receiving the highest number of valid votes in each category, and hence eligible for the prizes indicated in (3. PRIZES), as determined by VC13 at its sole discretion, will be deemed the winners (“Cycling Visionaries”) of this category. In the event of a dispute or tie or if for any other reason VC13 deems it necessary or appropriate, VC13 reserves the right to make the final determination as to which of the nominees will be declared the winners of the category. Nominees are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by VC13 at its sole discretion.
